1. PRESENTATION OF THE SERVICE

SportFriends (hereinafter "the Application" or "the Service") is a geolocated social network mobile application operating on the principle of a "Mesh Network", designed to connect athletes who wish to practice physical activities together.

2. ACCEPTANCE OF TERMS

Use of the Application implies full and complete acceptance of these Terms of Use ("ToU"). These ToU constitute an agreement between the user ("You" or "the User") and the Publisher.

By creating an account or using the Service, you acknowledge having read, understood and accepted without reservation these ToU.

If you do not accept these terms, you must immediately cease using the Application.

3. ACCESS TO THE SERVICE AND FREE USE

3.1 Completely Free

The SportFriends Application is entirely free. You can create and join an unlimited number of "Spots" (sporting events) without any fees, subscriptions or in-app purchases.

3.2 Access Requirements

Access to the Service requires:

  • A compatible mobile device
  • An active Internet connection
  • Geolocation enabled
  • Being at least 16 years old (or having parental authorization for minors between 16 and 18 years old)

3.3 Account Creation

To use the Application, you must create an account by providing accurate, complete and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials.

4. HOW THE SERVICE WORKS

4.1 "Spots"

A "Spot" is a geolocated sporting event created by a user. Each Spot includes:

  • A precise geographic location
  • A type of sporting activity
  • A meeting date and time
  • A discussion space for participants
  • The ability to share media (photos, videos)

4.2 Unlimited Creation

You can create as many Spots as you wish, without any limit on number or frequency. You can also join an unlimited number of Spots created by other users.

4.3 Mesh Network

The Application operates on a decentralized network principle (Mesh Network), enabling local and dynamic discovery of Spots near your geographic position.

5. DATA EPHEMERALITY AND "SCRUBBING" POLICY

5.1 Fundamental Principle

SportFriends does not archive data permanently. The Application is designed according to an ephemerality principle aimed at protecting your privacy and maintaining a dynamic and current network.

5.2 Hiding After 7 Days of Inactivity

Inactive discussions and Spots (without new messages or interactions) are automatically hidden from the user interface after 7 consecutive days of inactivity.

5.3 Permanent Deletion After 30 Days

All data associated with a Spot (messages, media, photos, videos, metadata) are permanently and irrevocably deleted from our servers after 30 consecutive days of inactivity.

This deletion is irreversible. We do not retain any backup copies of this data beyond this period.

5.4 User Responsibility

It is your responsibility to locally save any content you wish to keep beyond the 30-day period. The Publisher cannot be held responsible for data loss resulting from this scrubbing policy.

5.5 Exceptions

Only data strictly necessary for the operation of the user account (identifier, email, profile preferences) is retained as long as the account remains active. This data can be deleted at any time upon user request.

6. "WOMEN ONLY" SPACES AND GENDER VERIFICATION

6.1 Spots Reserved for Women

The Application allows the creation of "Women Only" Spots (reserved for women), designed to provide a safe and inclusive space for users who wish to practice sport among women.

6.2 Access Conditions

Access to "Women Only" Spots is reserved for users who have declared their gender as "Female" in their profile.

6.3 Verification System and Cooldown Period

In order to prevent abuse and guarantee the integrity of "Women Only" spaces, the following rules apply:

  • Any modification of gender in the user profile triggers a 30-day cooldown period
  • During this period, the user cannot access "Women Only" Spots
  • This measure applies to any gender change, regardless of the direction of the change
  • New accounts can immediately access "Women Only" Spots if the "Female" gender is selected upon creation

6.4 Compliance and Sanctions

Any attempt to circumvent the verification system, any false declaration of gender in order to improperly access "Women Only" spaces, or any inappropriate behavior in these spaces will result in:

  • Immediate suspension of the account
  • Permanent deletion of the account in case of repeat offenses
  • Reporting to the competent authorities if necessary

6.5 Non-Discrimination

This feature does not constitute discrimination but a protection and inclusion measure, in accordance with the principles of equality and safety. It aims to allow all users to practice sport in an environment where they feel safe.

7. DISCLAIMER OF PHYSICAL LIABILITY

7.1 Role as Digital Facilitator

SportFriends is exclusively a digital networking tool. We are not organizers, supervisors or responsible parties for sporting meetings that take place in the real world.

7.2 User Responsibility

By using the Application, you acknowledge and accept that:

  • You participate in sporting activities at your own risk
  • You are solely responsible for your physical condition and fitness to practice the chosen activity
  • You should consult a healthcare professional before engaging in any intense sporting activity
  • You must comply with the safety rules specific to each sport
  • You must ensure you have civil liability insurance covering sporting activities

7.3 Exclusion of Liability

The Publisher disclaims all liability in case of:

  • Injury, accident or incident occurring during a sporting meeting organized via the Application
  • Physical, material or immaterial damage resulting from the practice of a sporting activity
  • Inappropriate behavior, negligence or fault of another user during a real meeting
  • Theft, loss or deterioration of personal belongings during a Spot
  • Non-attendance of a participant at a Spot
  • Adverse weather conditions or state of sports facilities

7.4 Safety Recommendations

We strongly recommend that you:

  • Meet other participants in public and frequented places
  • Inform a close person of your participation in a Spot (location, time, activity)
  • Check the identity and profiles of other participants before the meeting
  • Report any suspicious or inappropriate behavior via the Application
  • Never share sensitive personal information (home address, banking details, etc.)

8. USER OBLIGATIONS AND BEHAVIOR

8.1 Compliant Use

You agree to use the Application in accordance with its purpose and these ToU. You are specifically prohibited from:

  • Publishing illegal, defamatory, abusive, racist, sexist, homophobic or discriminatory content
  • Harassing, threatening or intimidating other users
  • Impersonating another person
  • Distributing pornographic or child pornographic content
  • Promoting products or services without authorization
  • Attempting to hack, alter or disrupt the operation of the Application
  • Using bots, scripts or any automated means to access the Service
  • Collecting personal data from other users without their consent

8.2 Reporting

You can report any inappropriate content or behavior via the reporting feature built into the Application. We reserve the right to review and remove any reported content.

8.3 Sanctions

In case of violation of these ToU, the Publisher reserves the right, without notice or compensation, to:

  • Remove any inappropriate content
  • Temporarily suspend your account
  • Permanently delete your account
  • Initiate legal proceedings if necessary

9. INTELLECTUAL PROPERTY

9.1 Publisher's Rights

The Application, its design, source code, logos, trademarks and all elements that compose it are the exclusive property of the Publisher and are protected by French and international intellectual property laws.

9.2 License of Use

The Publisher grants you a personal, non-exclusive, non-transferable and revocable license to use the Application for your personal and non-commercial use.

9.3 User Content

You retain ownership of the content you publish on the Application. However, by publishing content, you grant the Publisher a worldwide, free, non-exclusive license to use, reproduce, modify and distribute this content in connection with the operation of the Service.

This license automatically ends when the content is deleted (manually or via the scrubbing policy).

10. PERSONAL DATA AND PRIVACY

10.1 GDPR Compliance

The processing of your personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

10.4 Geolocation

The Application requires access to your geolocation to function. You can disable this feature in your device settings, but this will render the Application unusable.

Your location data is only used to display nearby Spots and is not retained beyond the time necessary for the Service to function.

11. SERVICE AVAILABILITY AND MODIFICATIONS

11.1 Availability

We strive to keep the Application accessible 24/7, but cannot guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates or technical problems.

11.2 Modifications

The Publisher reserves the right to modify, suspend or discontinue all or part of the Service at any time, without notice or compensation.

11.3 Evolution of the ToU

These ToU may be modified at any time. Users will be informed of any substantial modification via the Application or by email. Continued use of the Service after modification constitutes acceptance of the new ToU.

12. TERMINATION

12.1 Termination by the User

You can delete your account at any time from the Application settings. Deletion is immediate and results in the erasure of all your personal data in accordance with our privacy policy.

12.2 Termination by the Publisher

The Publisher may suspend or delete your account in case of violation of these ToU, without notice or compensation.

13. LIMITATION OF LIABILITY

To the extent permitted by law, the Publisher cannot be held liable for:

  • Indirect, incidental or consequential damages resulting from the use or inability to use the Service
  • Data loss due to the scrubbing policy or any technical malfunction
  • The behavior of other users
  • The accuracy, reliability or quality of information provided by users
  • Service interruptions, bugs or technical errors

In any case, the Publisher's total liability shall not exceed the sum of 100 euros.

14. APPLICABLE LAW AND JURISDICTION

14.1 Applicable Law

These ToU are governed by French law.

14.2 Mediation

In case of contradiction between the French version of the ToU and any translation, the French version shall prevail.
